The Tema Excessive Courtroom has fined 18 delivery traces a complete of GH¢54,000 for submitting their defence late in a case introduced towards them by Johnny Mantey, Tema District Chair of the Ghana Institute of Freight Forwarders.
Mantey, represented by lawyer Noah Adamtey, filed the lawsuit on January 21, 2025.
He accused the delivery traces of violating the Transport Authority Act 1122, which requires them to submit their service fees to the Ghana Ports and Harbours Authority for approval.
The defendants initially entered a conditional look on January 31, 2025, however did not request that the writ be struck out throughout the required 14-day window.
Their look routinely grew to become unconditional, but they nonetheless did not file a defence throughout the subsequent 14 days as required by regulation.
Because of this, the plaintiff filed a movement on March 14, 2025, looking for a judgment in default of defence. The courtroom scheduled a listening to for March 27, 2025.
Nonetheless, on the listening to, the plaintiff’s attorneys selected to withdraw the movement, which the courtroom accepted.
Justice Cynthia Wiredu, presiding over the case, awarded a value of GH¢54,000 towards the defendants for his or her late submitting.
Lawyer Noah Adamtey stated the plaintiff will now reply to the defence, after which the case will proceed.
